Evaluation of Athletic Fields Update - October 25, 2004

This is a clarification of the Evaluation of Athletic Fields Update we sent out on Friday, October 22, 2004.

In the Friday update we stated that we were continuing the discussion of two City Council Agenda Items related to the Evaluation of City Athletic Fields and a Citywide Park & Recreation Facility Needs Assessment because the City had received a letter from an attorney representing the Heather School neighborhood raising legal questions. The City wanted to consider these issues before the City Council proceeds.

In the letter, dated October 21, 2004, we were asked to send any correspondence or make any inquiries regarding this matter c/o Robin Kennedy, Esq. at the law firm of Miller, Starr & Regalia, in Palo Alto. The City had previously received a letter from Robin Kennedy dated June 18, 2004 regarding the Heather School athletic field proposal saying that their firm has been retained by Heather Neighbors.

We have since received a clarification from a representative of the Heather Neighborhood indicating that the letter dated October 21, 2004 addressed to the City was not written by an attorney. We appreciate the clarification.

The City will review the issues in the October 21, 2004 letter before these items are scheduled for City Council consideration. When the City completes its response to that letter, we will forward it to Robin Kennedy, Esq. at the law firm of Miller, Starr & Regalia, as requested.
