How can I get an Encroachment Permit? Why do I need one?The San Carlos Municipal Code governs the use of the public right-of-way by individuals. The director of Public Works is authorized to issue an encroachment permit, which allows a person to perform construction work within the public right-of-way. This type of work frequently includes retaining walls, driveways, parking ramps, stairways, storm drains and fences. To make a positive finding for such a permit, the director should be able to confirm the following:
- That there is some public benefit to the encroachment-such as added off-street parking spaces, sidewalks, safer site distances from intersections, etc.
- That the encroachment will not unduly restrict travel in the public right-of-way.
- That the city will be protected from liability for injury or property damage resulting from the encroachment.
- That the performance of all the conditions and requirements of the permit may require a guarantee by the posting of a bond with the city.
