a) Approval of minutes: M/S Phillips/Thompson to approve the April 4, 2005 Planning Commission Minutes as submitted. Motion passed 3:0.

4. Public Comment

Persons wishing to address the Planning Commission on matters not on the posted agenda may do so. Five individuals are allowed to speak and each is limited to two minutes. Speakers representing organizations who require more time are requested to speak at the end of the Commission meeting under Public Comment.
If there are more than five individuals wishing to speak during public comment, the Planning Commissioner will draw five speaker cards from those submitted to speak during this time. The balance of the Public Comment speakers will be called upon during the Public Comment agenda item at the end of the Planning Commission Meeting.

Procedure for Public Hearing:

Staff will present a report on the history, physical features, etc., on the application followed with the staff’s recommendations. The applicant will make a presentation. Thereafter, interested members of the community may speak on the proposal. When all interested parties have had an opportunity to be heard, the hearing will be closed, and no further discussion from the floor can be held. The Commission will then consider the evidence and make its recommendation. If you challenge a public hearing item in Court you may be limited to raising only those issues you or someone else raised at the public hearing described in this notice, the public notice, or in written correspondence delivered to the City at or prior to the public hearing. Speakers should fill out a speakers form, found by the door, and hand it to the recording secretary prior to addressing the Commission. The speaker should come up to the microphone to speak since the meeting is being recorded. This will assist staff in preparing the minutes.

a) Public Hearing for the purpose of hearing and considering all comments of all persons interested in or concerned with the application of John Baer, Pilates Family for a Conditional Use Permit pursuant to San Carlos Municipal Code Section 18.86 and 18.124 to permit an instructional facility in the CR (Central Retail Core) and the Combining District ER (Entertainment and Recreation Facilities) Districts at 677 Laurel Street, San Carlos (Assessor’s Parcel Number 050 133 220).

Staff made a brief presentation of the item, addressed questions from the Commissioners and recommended a change to proposed condition number three allowing up to twelve occupants of the tenant space during the proposed business hours with the exception of Fridays between 5:00 and 6:00 p.m.

John Baer spoke in support of the proposal.

The applicant, Mark Lubarsky, supported the application and informed the Commission that he agreed with the proposed conditions as revised.

M/S Thompson/Phillips to approve the Conditional Use Permit with revisions to the date of submittal and condition number three allowing up to twelve occupants of the tenant space during the proposed business hours with the exception of Fridays between 5:00 and 6:00 p.m.

Motion carried 3:0.

b) Public Hearing for the purpose of hearing and considering all comments of all persons interested in or concerned with the application of Vadim Melik-Karamov, VMK Design Group for Lidia Gronsky (property owner) for a Mitigated Negative Declaration, Grading and Dirt Haul Approval Certificate, Architectural Review, Conditional Use Permit and a Tentative Map pursuant to San Carlos Municipal Code Sections 12.08, 15.36, 17.24, 18.116.130 and 18.124 associated with the proposed construction of a new, three-story, eight-unit condominium building at 144/150 Elm Street (APN: 045-312-040).

This item was continued to the May 2, 2005 meeting due to a lack of voting quorum (Chair Iwasa recused herself from voting on this item and Commissioners Divney and Prehm were unable to attend due to illness).

a) Report on recent City Council actions

None.

b) Planning Commission comments or reports

Commissioner Thompson reported that he had attended two Athletic Field Use Committee meetings and would continue meeting every other Thursday through August of 2005.

c) Correspondence

Ms. Cullinan noted that each Commissioner received a letter from Diane Sugitachiof of 476 Wellington Drive dated April 8, 2005 regarding 1866 Carmelita Drive. She further noted that the issue of creek setbacks had been addressed at the Joint Planning Commission/City Council meeting and that the tree removal issue would be addressed through code enforcement investigation.

d) Planning Staff comments, reports and updates of current projects

Ms. Cullinan informed the Commission that 144/150 Elm Street, 1129 Old County Road and 2911 Appian Way are tentatively scheduled for Commission consideration on May 2, 2005. Ms. Cullinan also provided an update on ERA's analysis of entertainment, recreation and instructional uses in commercial and industrial areas, and the Palo Alto Medical Foundation project.
