Chair Phillips explained that Item 5a on the Agenda is a Public Hearing Item and noted that the Public Hearing would be moved up in the Agenda and be considered before New Business.

Andrea Mardesich, Planner, presented the item.
Commissioner Shugart inquired about the number of parking spaces currently on site and how 77 spaces could be accommodated.
Andrea Mardesich replied that the parking lot would be re-configured and re-striped to achieve 77 spaces.
Commissioner San Filippo commented about the lack of lighting at the building frontages near the terminus of East San Carlos Avenue.He commented that, combined with the movement of vehicles and pick up and drop off of youth, it appeared to be a safety problem.
Commissioners San Filippo, Divney and Chair Phillips discussed options for lighting which would not involve large capital expenditure due to the short term of the Use Permit.
John Paye, Applicant and owner of 595 Industrial Road and 850 E. San Carlos Avenue, talked about the history of his ownership of the buildings starting in November 2004.He commented that the recreational use across E. San Carlos is primarily adult user/drivers, whereas his uses are youth businesses with pick-up and drop-off.He indicated that he plans to light the rear buildings at spaces D1 and D2.He indicated that his ultimate goal is to participate in some capacity in the City’s interest for a Hotel at the site.
Commissioner Iwasa inquired about the number of tenant spaces, 14 vs. 16 and asked if the Staff Report is in error.
Commissioner San Filippo asked if there are problems with traffic.
John Paye said that there is a problem with large trucks that use the end of East San Carlos Avenue and his parking lot to turn around.He noted that a sign for No Left Turn between 4Pm and 7PM on Industrial Road might address the problem.

Commissioner Shugart read modifications to Conditions 1, 2 and 3.
Commissioner Iwasa indicated some clerical notations she would give to Staff.She also suggested a new Condition requiring a lighting plan for review and approval by Staff.
Commissioner San Filippo asked about the potential for a No Left Turn sign.
Deputy City Attorney, Greg Rubens, noted that it would the Department of Public Works authority to make a determination of necessity for a sign.
Commissioner Shugart noted that a study would also necessitate getting input about impact on other users of Industrial Road.
M/S Divney/Shugart, that the Planning Commission approve a request for a Conditional Use Permit as a blanket conditional use permit for the 29,169 square foot multi tenant building at 850 East San Carlos Avenue in San Carlos based on the findings and for the reasons incorporated in the Staff Report and with modifications to Conditions 1, 2 and 3 and the addition of a Condition to require a lighting plan for the rear buildings for review and approval by the Planning Department.
Motion passed 5-0.

Consideration of a request pursuant to San Carlos Municipal Code (SCMC) Section 17.28.010 to grant an extension of time for filing a final parcel map associated with the construction of a four unit condominium building at 500 Walnut Street, San Carlos (Assessor's Parcel Number 050-064-040) approved by the San Carlos Planning Commission on May 1, 2006 and effective May 11, 2006.
Planning Manager, Deborah Nelson, presented the item.
Commissioner Shugart asked when would the Commission not approve this type of request.
Planning Manager, Deborah Nelson, commented that if circumstances had changed since the original approval, such as a change in the General Plan, Zoning Ordinance or other regulation, the Commission could consider not extending the time frame for filing for a Final Map.
M/S Shugart/Iwasa that the Planning Commission approve the request of Negin Hakimian to extend the approval date to file a Final Parcel Map associated with the construction of 500 Walnut Street, San Carlos (Assessor’s Parcel Number 050-064-040) for a period of one year with an expiration date of May 11, 2009.

Consideration of ARCHITECTURAL CHANGES including colors and materials pursuant to Condition 8 of the July 16, 2007 approval of 85 Hartford Avenue in the R-1 (Single Family) Residential District in San Carlos (Assessor's Parcel Number 045-212-080).

Gavin Moynahan, Assistant Planner, described the changes to the previously approved design of 85 Hartford and the reasons it was before the Planning Commission.He provided additional graphics to the Commission showing the changes.He noted that the design changes do not significantly affect the original integrity of design.Most of the changes (other than color and materials) increase privacy for the neighbors.He also noted that a Memo dated December 15, 2008 provided to the Commission this evening, included a request by the applicant to change the existing Condition #8.The change would switch authority for any future changes deemed not significant to be determined and approved at Staff level rather than at the Planning Commission level.
Robert Broderson, Applicant, presented the changes to materials and colors.He asked the Commission to remove a requirement that any change requires coming back to the Planning Commission.
Commissioner Divney inquired about the roof solar panels.
Commissioner Shugart commented that the design is a good one for Hartford Avenue.She also asked if the Applicant had heard from the neighbor.
Gavin Moynahan described the outreach process and noted that no comments were received.
Commissioner Divney indicated he is not interested in changing the word “shall” to “may” with regard to determination of substantive changes.
M/S San Filippo/Divney, that the Planning Commission approve the changes to colors, materials, reduction of side-facing windows, and relocation of a hot tub pursuant to Condition #8 of the Residential Design Review Committee approval in the R-1 (Single Family) Residential District for 85 Hartford Avenue, San Carlos (Assessor’s Parcel Number 045-212-080) based on the findings and for the reason incorporated in the Staff Report dated July 16, 2007 and updated by the December 15, memo(s) from staff and the applicant’s revised plans dated October 22, 2008 and with the change to Condition #8 as follows:
“The colors and materials of the new residence shall be in substantial compliance with those presented to and approved by the Planning Commission on July 16, 2007.Any changes determined to be substantive shall require re-review by the Planning Commission as determined by the Planning Manager.Changes to colors, materials and elevations not determined to be significant may be reviewed and approved at the Staff level.”
Deputy City Attorney, Greg Rubens, advised the Planning Commission that the City Council appointed him as City Attorney effective December 16, 2008.He described that he will attend Planning Commission meetings the majority of the time.
Planning Manager, Deborah Nelson, advised the Planning Commission of the actions taken by the City Council on the General Plan Alternatives.Commissioners noted that the actions may affect future projects for Commission consideration.Commissioner Iwasa said that the GPAC is still reviewing the density issues in the context of the Land Use Element of the General Plan.
Planning Manager, Deborah Nelson, and Deputy City Attorney, Greg Rubens advised the Commission of the City Council consideration of a Final Focused EIR for the Winding Way project.
Commissioner Iwasa reported that GPAC will discuss the Land Use Element Goals, Policies and Actions for a total of 4 meetings to be held in December and January.
Planning Manager, Deborah Nelson, advised that the complaint about work performed in the vicinity of the creek on Carmelita has been referred to Code Enforcement.
Planning Manager, Deborah Nelson, advised the Commission that they will have a meeting on January 5, 2009.The item will be the Grand Boulevard Initiative Guiding Principles.A packet will be ready by December 19, 2008.
