On November 23, 2015, in response to concerns from residents and Downtown San Carlos business owners regarding rapidly-rising commercial rents, preserving the Downtown’s unique character, and the replacement of small, independent businesses with larger chain stores, the San Carlos City Council adopted an Urgency Ordinance imposing interim zoning on formula businesses in the Downtown Core. The City Council then adopted a 120-day extension of the Urgency Ordinance on December 14, 2015 to provided staff with time to study zoning options and existing conditions, gather community input, and draft an amendment to the Zoning Ordinance for Planning Commission and City Council consideration.
Since the Urgency Ordinance was put into effect, two replacement Ordinances have been adopted by the City Council to require formula business uses wishing to locate in the Downtown Core Area to first obtain a Conditional Use Permit – Ordinance 1502 on March 14, 2016 and Ordinance 1505 on June 27, 2016. Public Hearings were held by the Planning Commission, as set forth under Section 18.35.060 of the San Carlos Municipal Code, to make a recommendation on the proposed Zoning Code amendments to the City Council. In both cases, the Planning Commission recommended that the City Council not introduce an Ordinance to regulate formula business uses.
Ordinance 1505, which is currently in effect, is set to sunset on February 28, 2016 unless extended or made permanent by the City Council prior to that date. Unlike the previously adopted regulations on formula business uses, Ordinance 1501 defines a formula business as a use that has ten or more business locations in the nine-County Bay Area and is required by contract, business model, or practice to maintain standardized characteristics. Additionally, Ordinance 1505 only applies to the 600, 700 and 800 blocks of Laurel Street.
